User Data
- Name, email, and brokerage information for account creation and management.
- Phone number when you add it to your Compliance/Agent profile or account settings. We use your phone number to send you SMS (text message) notifications when new leads submit contact forms on your website, but only if you have opted in to receive such notifications in Settings → Contact Notifications. You may opt out at any time.
- Login credentials (stored securely; we do not store plain-text passwords).
- Profile and account settings you configure within the Service.
Lead Data
- Newsletter sign-ups: Name and email of visitors who subscribe to your newsletters through your site.
- Flyer downloads and similar actions: Name and email of potential clients who request flyers or other materials you offer through the Platform.
We act as a Data Processor for the leads you collect. We do not sell your client leads to third parties. We use this data strictly to facilitate the services you have requested, such as sending your automated newsletters or providing flyer access.
Property Data
- Details you input for AI-generated listings, including addresses, property features, descriptions, photos, and other listing content.
- Content you create or upload (pages, blog posts, media) in connection with the Service.
Automatically Collected Information
- Usage data: How you use the Service (e.g., pages visited, features used).
- Device and log data: IP address, browser type, operating system, and similar technical information.
2. How We Use Your Information
We use the information we collect to:
- Provide, operate, and improve the Service.
- Process your account and subscription.
- Send service-related communications (e.g., verification emails, password reset).
- Send SMS (text message) lead alerts to agents who have opted in via Settings → Contact Notifications. These are transactional notifications sent when a new lead submits a contact form on your site. Message and data rates may apply. You may opt out at any time.
- Send marketing or product updates where you have opted in.
- Fulfill lead-related services (e.g., delivering newsletters on your behalf).
- Analyze usage and improve our AI and product experience.
- Comply with legal obligations and enforce our Terms of Service.
3. AI Data Training
We may use anonymized, de-identified metadata to improve our AI's performance and accuracy for the Real Estate industry. We do not use your private property descriptions or identifiable client data to train our global AI models in a way that could identify you or your clients.
4. How We Share Your Information
We do not sell your personal information. We may share information:
- With your consent or at your direction.
- With service providers who assist us, under strict confidentiality obligations (see Section 5).
- To comply with law or respond to valid legal process.
- To protect rights and safety of TopShelf AI, our users, or the public.
5. Service Providers (Subprocessors)
We use trusted third-party service providers to operate the Service, including cloud hosting providers, email delivery services, payment processors, analytics providers, artificial intelligence processing providers, and SMS delivery services. Examples include Vercel (infrastructure), Resend (email delivery), Stripe (payments, when applicable), Anthropic (AI processing), and Twilio (SMS delivery for lead notifications). We require these subprocessors to protect your information under contractual obligations. A current list of key subprocessors is available upon request.
6. Real Estate & Listing Data
Property information submitted through the Service is provided by users and may originate from third-party sources such as Multiple Listing Services (MLS). TopShelf AI does not guarantee the accuracy, completeness, or reliability of listing information. TopShelf AI is not affiliated with or endorsed by any Multiple Listing Service (MLS) or real estate association.
Real Estate Lead Handling: When visitors submit information through websites or forms created using the Service (e.g., contact forms, newsletter sign-ups), that information is transmitted to the real estate professional operating the site. TopShelf AI processes this information solely to facilitate communication between the visitor and the real estate professional. We do not sell your client leads to third parties.
7. Data Retention
We retain your information for as long as your account is active or as needed to provide the Service, and thereafter as required by law or for legitimate business purposes (e.g., dispute resolution, compliance).
8. Security
We use administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.
9. Your Rights and Choices
Depending on your location, you may have the right to:
- Access the personal information we hold about you.
- Correct inaccurate information.
- Delete your information, subject to legal and contractual constraints.
- Opt out of marketing communications (e.g., via unsubscribe links).
- Opt out of SMS notifications at any time via Admin Dashboard → Settings → Contact Notifications by disabling the "Receive SMS" toggle. Changes take effect immediately.

Do Not Track: Some browsers offer a "Do Not Track" signal. Our Service does not currently respond to Do Not Track signals.
